Criminally Negligent Homicide
Criminally Negligent Homicide is a Class A misdemeanor in Alabama, carrying a possible sentencing range of up to one (1) year of imprisonment, unless the killing was involved while operating a motor vehicle or vessel, if so then the crime is a Class C felony with a punishment ranging from one (1) year to ten (1) years in prison. This is a negligence crime in which the accused negligently caused the death of another. Here, the intent (mens rea) element does not need to be proven by the state, mere negligent conduct will suffice.
