What Happens After a DUI Arrest in Alabama?

If you've been arrested for driving under the influence (DUI) in Alabama, you're likely feeling overwhelmed, anxious, and unsure of what comes next. At Dixon Law, we understand the gravity of the situation — and we're here to help.

Here's a clear breakdown of what you can expect after a DUI arrest in Alabama, and what steps you should take immediately to protect your rights and your future.

Step 1: The Arrest

When you are pulled over and the officer suspects you of being under the influence of alcohol or drugs, you may be asked to perform field sobriety tests or take a breathalyzer.

  • Refusing a test can lead to automatic license suspension.

  • If your BAC is 0.08% or higher (or 0.02% for drivers under 21), you'll likely be arrested and taken to jail.

➤ Key Tip:

Stay calm and avoid arguing. Anything you say can be used against you later in court.

Step 2: Booking and Bail

After the arrest, you'll be:

  • Taken to a local jail

  • Booked (your fingerprints and mugshot are taken)

  • Given a court date

You may be released on bail shortly after, depending on the circumstances and prior offenses.

Step 3: Driver's License Suspension

In Alabama, your license can be suspended within 45 days of your arrest — even before a court conviction.

You have only 10 days to request a hearing to fight the suspension. This is called an Administrative License Suspension (ALS) hearing.

➤ What You Can Do:

Contact a DUI attorney immediately to request this hearing and start preparing your defense.

Step 4: The Court Process

You will be required to appear in court to answer the DUI charge. This includes:

  • Arraignment (you enter a plea)

  • Pre-trial hearings

  • Possible trial

A conviction could result in:

  • Fines

  • Mandatory DUI classes

  • License suspension

  • Jail time (especially for repeat offenses)

Step 5: Long-Term Consequences

A DUI conviction in Alabama stays on your record for life — it can affect:

  • Employment opportunities

  • Auto insurance rates

  • Future legal matters
